Please read through the following terms and conditions ("Terms") carefully as they govern your access and use of the websites of Tam Kah ("we", "our", "us" or "Tam Kah") and the ordering of products from us. If you do not consent to these Terms, you may not order our products and should not continue to access or use www.tamkahseafood.com or www.tamkahsharksfin.com (collectively our "Sites").

PART A: TERMS AND CONDITIONS OF SALE
1. APPLICATION OF THESE TERMS
By accessing our Sites or by ordering our products (whether through our Sites, hotline, email or otherwise), you are deemed to have read, understood, and agreed to these Terms and any future amendments published on our Sites. It is your responsibility to review these Terms regularly.
2. YOUR STATUS
By placing an order through our Sites, you confirm that:
• You are legally capable of entering into binding contracts; and
• You are at least 18 years old. If you are under 18, you may only use our Sites with the involvement of a parent or guardian.
3. ORDERS AND CANCELLATIONS
3.1. Order Acceptance: When you make an order for our products (whether through our Sites, hotline, email or otherwise), we are not bound by your order until we have accepted it. Our acceptance of your order occurs when we send you a confirmation email.
3.2. Right to Reject: We reserve the right to reject any order in our sole discretion without providing any reason.
3.3. Cancellation by Us: We are entitled to cancel any order in our sole discretion for any reason, including without limitation:
• a) The unavailability of products ordered;
• b) An error in the price, description, or otherwise of our products; or
• c) An error in your order.
3.4. Refund Upon Cancellation: If your order is cancelled by us, any payment already received will be refunded to you. You agree that apart from any refund given, we will not be liable for any other expenses, damages, costs, or loss whatsoever arising from the cancellation.
3.5. Cancellation Due to Your Breach: If your order is cancelled by us as a result of your breach of these Terms, we may deduct from any refund an amount representing expenses, damages, or loss suffered by us arising from your breach.
4. YOUR RESPONSIBILITIES REGARDING YOUR ORDER
4.1. Accurate Information: You must provide accurate and current information when placing an order. We are not responsible for any delay or non-performance due to inaccurate or incomplete information provided by you (including inaccurate contact details or incomplete delivery address).
4.2. Serving Quantities: Serving quantities and weights provided are approximations and are meant as a guide only. It is your responsibility to ensure products ordered are sufficient for your needs.
4.3. Trash Disposal: Tam Kah does not provide trash disposal services. It is your responsibility to ensure all trash is properly disposed of. We will not be liable for any costs arising from failure to dispose of trash properly.
5. FOOD ALLERGIES AND SAFETY
5.1. Allergen Disclaimer: All our products are prepared in kitchens that use milk, eggs, gluten, seafood, peanuts, other nuts, sesame seeds, capsicum, and other allergens. While we have strict cross-contamination policies, we cannot guarantee a total absence of these allergens in any of our products.
You must exercise your own discretion as to whether our food is safe for consumption if you have any food allergies. You are responsible for cautioning any person with food allergies who may consume our products. We do not assume any liability for adverse reactions caused directly or indirectly from the consumption of our food.
5.2. Food Handling Precautions: You must take usual food-handling precautions when handling our products, including without limitation:
• a) Not exposing food to flies, dust, or other impurities;
• b) Not consuming food which has passed the consumption date/time;
• c) Not re-freezing food which has been thawed;
• d) Not consuming raw or undercooked food meant to be cooked;
• e) Washing utensils properly before use; and
• f) Observing any specific food handling measures we have informed you of.
5.3. Failure to Observe Precautions: If you fail to observe the precautions mentioned above or other usual precautions when handling food, we will not be liable for any damages, expenses, costs, or loss arising directly or indirectly from such failure.
6. PRODUCT DESCRIPTIONS AND IMAGES
All images or photos on our Sites are for illustration purposes only and are not a representation or description of the products being sold. Actual items may vary from time to time due to seasonal changes, preparation methods, and other factors. Serving quantities and weights given are approximations and may be varied without prior notice.
7. PRICING AND PAYMENT
7.1. Payment Required: We shall not be bound to deliver products ordered unless we have received full payment.
7.2. GST: As a GST registered business, Goods & Services Tax will be payable on all orders at the prevailing rate required under Singapore law and will be automatically charged.
8. DELIVERY
8.1. Free Delivery: We offer free delivery for orders meeting the minimum amount specified on our Sites' homepage. This minimum amount may vary according to season and availability ($200 - $500).
8.2. Delivery Charges: For orders below the minimum amount, a delivery fee of $15 to $30 per address will apply, depending on location and/or order value.
8.3. Delivery Timing: We will do our best to deliver products according to your selected delivery slot. However, delivery timing may be affected by factors including traffic, road conditions, and weather. We cannot guarantee arrival according to your selected delivery slot.
8.4. Peak Periods: During peak seasons (including but not limited to Chinese New Year and public holidays), we cannot guarantee specific delivery time slots or preferred delivery days. Delivery schedules are subject to availability.
8.5. Failed Delivery: If delivery fails due to incorrect address information provided by you or unavailability of the recipient, a redelivery fee may apply. If redelivery is not possible, you may collect your order from our outlet, or we may cancel the order with a refund (less any delivery charges already incurred).
9. COLLECTION
9.1. Collection Points: You may choose to collect your order from our:
• Retail Outlet/Takeaway/Factory (28 Jln Kelulut); or
• Retail Outlet (Chinatown).
9.2. Advance Notice: To ensure stock availability, we strongly advise you to contact us 2–3 days in advance by email (sales@tamkahsharksfin.com) or phone. Alternatively, you may state your contact number in the "Note to Seller" section at checkout, and our team will contact you to confirm collection details. Stock availability is not guaranteed until confirmed by our team.
10. RECEIPT OF DELIVERY
10.1. Delivery to Another Person: If you request us to deliver products to another person, or if a person other than you takes possession at your requested delivery address, that person shall be acting as your agent to receive delivery on your behalf.
10.2. Deemed Receipt: You will be deemed to have received our products at the time of delivery, whether by your physical receipt of the products, your instruction to leave the products at your specified address, or upon confirmation of delivery by our delivery personnel (including but not limited to photographic confirmation, delivery tracking system updates, or verbal confirmation).
10.3. Conclusive Evidence: Unless you notify us of any issues with the products (such as damage, spoilage, or incorrect items) at the time of delivery or collection, your acceptance of the products (whether by taking physical possession, instructing us to leave the products, or failing to raise an immediate objection) shall be conclusive evidence that the delivered products are of satisfactory quality, fit for the purpose communicated, and are of the correct description and quantity.
11. SPOILED, DAMAGED, INCORRECT, OR MISSING PRODUCTS
11.1. Immediate Notification: Upon inspection at the time of delivery or collection, if you discover any products are spoiled, damaged, incorrect, or missing, you must notify us immediately at (+65) 6223 8770 / (+65) 6223 1611 / whatsapp message (+65) 8483 4842
11.2. Our Rights: You agree and acknowledge that:
• a) We have the right to inspect the products to determine whether they are in fact spoiled, damaged, incorrect, or missing.
• b) We may request you to return spoiled, damaged, or incorrect products to us before we provide any remedy.
• c) We may not be required to provide any remedy if you do not make reasonable efforts to prevent further damage or deterioration of the products.
11.3. Remedies: If we determine that products are spoiled, damaged, incorrect, or missing, we may at our sole discretion:
• a) Replace the spoiled or damaged products or provide correct or missing products;
• b) Refund an appropriate portion of the price paid; and/or
• c) Provide any other appropriate remedy.
12. REFUND POLICY
12.1. Scope of Refund: We accept full refunds only if the following conditions are met. Refunds apply only to the price of the product items purchased. Shipping or delivery charges are non-refundable.
12.2. Conditions to Qualify for Refund:
• a) Goods must be returned in their original condition (unopened and undamaged);
• b) Goods must be returned within 7 days from the date of purchase; and
• c) You must provide proof of purchase (e.g., receipt, email confirmation, SMS).
12.3. In-Person Processing: Refunds must be processed in-person at either of our collection points:
• Retail Outlet/Takeaway/Factory (28 Jln Kelulut); or
• Retail Outlet (Chinatown).
12.4. Form of Refund: Refunds are available either as a monetary refund or product exchange at our discretion.
13. RISK AND TITLE
13.1. Risk: The risk in the products shall pass to you upon your receipt of the delivery of the products (or upon collection, if applicable).
13.2. Title: Subject to our having received full payment for the products, title in the products shall pass to you upon your receipt of the delivery of the products.

PART C: GENERAL PROVISIONS
15. INTELLECTUAL PROPERTY
15.1. Ownership: All content on our Sites, including text, graphics, logos, icons, images, and software, as well as the selection, assembly, and arrangement thereof, are the property of Tam Kah or its content suppliers and are protected by Singapore and international copyright and trademark laws.
15.2. Permitted Use: You may not copy, reproduce, republish, download, post, broadcast, transmit, or otherwise use any content on our Sites except for your own personal, non-commercial use.
16. DISCLAIMER REGARDING USE OF OUR SITES
16.1. "As-Is" Basis: To the fullest extent permitted by law, the materials on our Sites are provided on an "as-is" basis and we expressly disclaim all representations or warranties, express or implied, of any kind with respect to use of the Sites.
16.2. Accuracy: While we take reasonable efforts to ensure information on our Sites is accurate, we do not guarantee that our Sites are free from errors or that products are available at the time of your order. We reserve the right to change information published on our Sites at any time.
16.3. Third-Party Links: Our Sites may contain links to third-party websites. We are not responsible for the operation or content of any such third-party website.
17. LIMITATION OF LIABILITY
17.1. Exclusion of Implied Terms: Except that any products provided shall be of satisfactory quality, to the fullest extent permitted by law, all other conditions, guarantees, representations, and warranties implied by statute or otherwise are expressly excluded.
17.2. Third-Party Delivery: We engage third-party delivery companies ("Delivery Company") to deliver products ordered by you. The staff of the Delivery Company are not our employees, and we are not responsible for their actions or omissions which are not the direct result of any specific instructions given by us.
17.3. Cap on Liability: In the event that we are found liable to you, you expressly agree that our total liability to you in relation to or arising from:
• a) Any order or any product provided by us shall not exceed twice the price of the product giving rise to such claims; and
• b) All other cases (including but not limited to your use of our Sites) shall not exceed $100.00.
17.4. Comprehensive Limitation: The limitation of liability under clause 17.3 applies to damages or compensation of any kind whether arising in contract, tort, equity, or otherwise. Notwithstanding anything to the contrary in these Terms, we shall not in any circumstances be liable for any indirect or punitive damages.
18. INDEMNITY
You agree to defend, indemnify, and hold harmless Tam Kah and its directors, officers, and affiliated companies against any payments, fees, damages, loss, awards, expenses, or costs in relation to any claim arising out of or in connection with a breach by you of any of these Terms.
19. FORCE MAJEURE (FRUSTRATION)
In the event of any circumstances arising which are not within our control, including but not limited to any act of God, governmental act, fire, flood, explosion, civil commotion, strike, or labour dispute, we shall not be liable to you for any delay or non-performance of our obligations.
20. TERMINATION
Without prejudice to any rights or remedies available to us, if we consider that you have breached any of these Terms or in any other circumstances that we consider appropriate, we may in our sole discretion immediately terminate your access to our Sites or your contract for the provision of our products without any prior notice.
21. GENERAL PROVISIONS
21.1. Waiver: No waiver of any rights or remedies by us shall be effective unless made in writing and signed by an authorised representative. A failure by us to exercise or enforce any rights shall not be deemed a waiver.
21.2. Severability: If any provision of these Terms is determined to be illegal, invalid, or unenforceable, the legality, validity, and enforceability of the remaining provisions shall not be affected.
21.3. Entire Agreement: These Terms contain the entire agreement between the parties and supersede any previous agreement, understanding, or arrangement whatsoever between the parties.
21.4. Right to Vary: We may revise these Terms at any time by updating our Sites. It is your responsibility to check periodically for changes. Your continued use of our Sites or your order for our products following any updates constitutes your acceptance of these changes.
22. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of Singapore. The parties hereby agree to submit to the exclusive jurisdiction of the courts of Singapore.
